In France, the law requires drivers to take out car insurance in order to drive legally. Drivers with a malus often find themselves at an impasse when it comes to getting insured. They may see their premium doubled or face refusal from insurers to issue a new contract. In cases of high malus, insurance for the malussed is necessary.
The CRM not only allows the driver to be accepted by an insurance company but also plays a role in determining the insurance premium amount. It is included in each driver’s record of information.

What is a Malussed Driver?
The bonus-malus, or reduction-majoration coefficient or CRM, is a coefficient applied to your insurance rate at each annual renewal.
In the definition of bonus-malus, it’s important to know that a coefficient below 1 reduces your premium. Above 1, it increases it. The malus represents the amount when the driver is responsible for an accident. It is expressed as a percentage. Each responsible claim results in a 25% increase in the coefficient applied to the premium.
For a shared responsibility accident, the malus is halved, i.e., 12.5%.
In vehicle insurance, there is a nearly systematic classification of drivers based on their profile. When a insured presents themselves to an insurance company to insure your car, it usually doesn’t take long before you are assigned a driver profile.
Depending on your driving experience (young driver, experienced driver) and/or your past (accidents, terminated driver, etc.), you will be classified as a young driver, a malussed driver, a claims driver, etc. Be aware that this driver profile directly influences the cost of your auto insurance.
Insurers apply a malus for young drivers due to their lack of experience. It only applies in cases of road accidents where the insured’s responsibility is partially or fully involved. However, for them, there is no penalty in case of a non-responsible accident or glass breakage, theft, or vandalism.
How Does One Become Malussed?
A malussed driver is not necessarily a poor driver. It is, unfortunately, easy to become a “risky” or “malussed” profile. Particularly after:
- Three consecutive glass breakages or responsible accidents.
- License suspension or an accident due to speeding above the authorized limit.
- License suspension or an accident due to blood alcohol level exceeding the legal limit.
- Multiple payment difficulties.
After 2 years without a responsible accident, your malus is canceled, and your coefficient automatically drops to 1.
Subsequently, each year of driving without a responsible accident increases your bonus by 5%.
If you have a bonus of 0.50 for at least 3 years, your first responsible accident in 3 years will not affect your rate.
The bonus-malus or “reduction-majoration coefficient” follows you throughout your insured career: it appears in the information record that your new insurer will necessarily request and will determine your premium amount.
Can the insurer cancel a car insurance contract after an accident?
After an accident, the insurer has the right to cancel the mandatory liability coverage outside of renewal:
If the driver of the insured car was intoxicated or under drug influence;
If the accident is a violation of the Traffic Code resulting in a judicial or administrative decision to suspend the driver’s license for at least one month, or a decision to revoke that license.
This rule is found in Article A. 211-1-2 of the Insurance Code
What to do if you have difficulty finding insurance for a malussed driver?
To subscribe to a new insurance contract, each future insured must present an information record. The insurer sends this annually on the contract’s renewal date or upon the insured’s request. It includes the number of declared claims over a 5-year period.
It also indicates the coefficient obtained (malus or bonus).
Many insurers refuse coverage to malussed drivers. Some even go as far as ending their contracts. Some insurance companies specialize in coverage for malussed drivers.
Fortunately, today there are auto insurance policies specifically reserved for people with a malus or those who have been canceled.
Calling the BCT:
If you experience two consecutive refusals from insurers to subscribe to a canceled auto insurance contract for a malussed driver, you can appeal to the Central Tarification Office.
This French government body’s main mission is to intervene with insurers when a driver faces difficulties in obtaining auto coverage. When a driver who has faced two refusals approaches them, they require the insurer to set up a specific contract.
The BCT evaluates the insured’s profile and sets the amount of your insurance premium. However, it is the insured’s choice to select their future insurer.
The BCT can therefore compel a company to provide you with minimum coverage for a year. However, it cannot force you to subscribe to additional guarantees.
If this option is accessible to everyone, the procedures can be lengthy and sometimes tedious: it can take up to three months to be insured again.

It is better not to own a large engine in addition to a significant malus.
