The terms legal protection and defense-appeal are often confused wrongly by insureds when they seek to engage a person’s civil liability during a dispute. Although these two guarantees can be included in the same contract, the conditions for their implementation are somewhat different. How to distinguish them?

The Defense-Recourse Guarantee: A Restricted Guarantee

The defense-appeal is a guarantee found in most liability contracts. In other words, it is an accessory guarantee to civil liability. This guarantee intervenes when the conditions for liability are not clearly defined at the time of a claim. Two situations are then possible:

Defense Action

In a defense action, the insurer can cover the criminal and civil defense of the insured. For example, the insured is accused in a collision by a third party claiming that their vehicle was damaged, without necessarily implicating their fault responsibility due to lack of evidence. In the case of auto insurance, the insurer may commit to covering part or all of the costs, such as appointing a lawyer or paying experts in accident analysis to determine the causes of the accident.

Recourse Action

In a recourse action, the insurer assists its insured in procedures and legal recourses so that they can obtain compensation for bodily or material damages. The insurer then commits to claiming, either amicably or in court, compensation for the prejudice suffered by its insured from the damage to the author. The conditions for covering costs are roughly the same as in defense.

Coverage Cap

It should not be forgotten that this guarantee is capped within the limits of what the contract subscribed by the insured covers. This ceiling can be specific to the defense-recourse guarantee but may also be confused with the overall benefit ceiling of the contract. The particularity of this guarantee lies in the fact that it cannot be dissociated from the notion of civil liability. In other words, it is automatically triggered for legal actions or amicable recourses aimed at determining the perpetrator of the damage who will be liable to compensate the victim under their civil responsibility.

The Legal Protection Guarantee: A Broader Application Guarantee

The legal protection insurance is defined by Article L127-1 of the Insurance Code as any operation aimed at defending, representing in claims the insured or against a claim made against them. There is a strong similarity with the defense-recourse guarantee, raising a border issue, with its main purpose being to ensure the civil liability of the policyholder. Legal protection insurance comes in three forms of guarantees:

Different Contracts

This legal protection insurance is primarily a contract that any insured can obtain by subscribing to one with their insurance company. In many cases, this coverage can be included in various policies such as auto or home insurance, but it can also be in a separate contract. Furthermore, most of the guarantees included in legal protection also cover all members of the family of the policyholder.

Wide Scope of Application

However, this guarantee, although it can intervene in disputes related to the civil liability of the insured, its scope of application is very broad. This type of guarantee provides more comprehensive protection for the insured, such as access to legal advice at any point, if the nature of the dispute is covered by the guarantees offered by the policy. It prevents conflict risks while offering coverage for defense costs for the insured, which can occur in the private or professional sphere of the insured and their loved ones.

Distinguishing Legal Protection and Defense-Recourse

Major Differences Between These Two Guarantees

To understand the nuances between these two protection guarantees, here are some key points:

  • Legal protection: aims to assist you in your procedures, providing support if you need to resolve a dispute, whether in amicable or judicial phases.
  • Guarantee defense-appeal: allows your insurer to represent you in these procedures, letting them handle communications with the insurer of the other involved party in the dispute, thus avoiding many administrative steps.

Characteristics of the Defense-Recourse Guarantee

This guarantee is present in many civil liability contracts. It comes into play when the activation conditions of your civil liability are unclear. In brief, as long as the responsibilities of all parties are not fully defined, this is the guarantee that you should invoke to:

  • Be defended before the courts.
  • Exercise a recourse to obtain compensation for bodily or material damages (within the limits of what your contract covers).

Specifics of Legal Protection

In most cases, legal protection is provided through a specific contract, unlike the defense-appeal, which is an included guarantee in a civil liability contract.

It has several advantages:

  • Access to direct and ongoing legal information.
  • Coverage of defense costs in various areas, whether in your private or professional life: consumption, housing, and work.

  • The Defense-Recourse is present in most Liability contracts, as an accessory guarantee to civil liability. It is activated when the conditions for invoking the guarantee are not yet defined.
  • The Legal Protection is sometimes included in Liability contracts, but it is often sold separately. It has no connection with the Civil Responsibility guarantee and operates under its own conditions (coverage amount, intervention threshold, and premium different from the claims premium).

To choose between these two guarantees, it is essential to clearly understand your specific needs and carefully read the terms of your insurance contract.
