What is an RC pyrotechnician ?

Liability insurance for pyrotechnicians covers

  • all individuals holding the necessary authorizations
  • and having the required permits for firing fireworks

against any third-party claims resulting from bodily injury, property damage, or intangible damages, provided that their responsibility is engaged within the scope of their fireworks firing activity.

Organizing a fireworks display, a show, or an event involving pyrotechnic elements requires special care and attention during preparations. Ephemeral and spectacular, they must nonetheless comply with strict safety regulations for everyone’s safety.

Among these concerns are naturally questions and issues related to insurance, which due to their particular nature are reserved for a very small circle of highly specialized intermediaries.

What are the obligations during a pyrotechnic event ?

A pyrotechnic show is a performance presented to an audience as part of a public or private event.

The organization of “pyrotechnic displays” is subject to strict rules.

The regulations concerning fireworks were amended by decree n° 2010-455 of May 4, 2010, related to the marketing and control of explosive products.

This text concerns the articles used: classification of products, standards, compliance, safety, conditions of acquisition and delivery to persons, controls, and sanctions.

Another decree (n° 2010-580 from May 31, 2010) outlines the rules regarding the acquisition, possession, and use of entertainment pyrotechnics and concerns their use specifically.

The order of July 1, 2015, relating to the marketing of explosive products, has defined new categories of entertainment pyrotechnics: categories F1, F2, F3, and F4.

Individuals handling products classified in categories F2 and F3 (fired by mortar), F4, T2, and P2 must now hold a qualification certificate.

The qualification certificate is issued by the prefect to individuals demonstrating sufficient knowledge of:

  • pyrotechnic articles,
  • the technical and regulatory conditions of their implementation and the risks they entail.

The certificate is valid for:

5 years for level 1, 2 years for level 2.

What are the obligations for organizing fireworks displays ?

Every fireworks display must have an organizer responsible for the show.

The organizer can:

  • Be a municipality, an association, or an individual.
  • Conduct the show themselves (for example, a municipality with qualified personnel) or hire a specialized company.

The organizer must handle the fireworks declaration, appoint a responsible person for product storage before the show, and a responsible person for execution.

Make the declaration

Every fireworks display must be officially declared.

All fireworks organizers must submit a prior declaration to the mayor and the prefect at least 1 month before the firing date.

This dossier must include the liability insurance certificate.

Storage

A temporary storage location for pyrotechnic devices needs to be planned.

Storage of pyrotechnic products is permitted for a maximum period of 15 days prior to firing.

The storage location cannot be more than 50 km from the site of the show.

Conditions for storing firework displays:

Storage is prohibited:

  • In a residence, nor in a public access facility (ERP), or within 50 m of a residence or public access facility, nor in the basement or on an upper floor,
  • Within 100 m of a high-rise building (whose lower floor is at least 28 m above ground),
  • Within 100 m of radio or radar transmitters or high-voltage lines.
  • The door of the storage room, outside, must signal the presence of pyrotechnics inside and display a warning sign against fire, cigarettes, and sparks.

Firing the fireworks

This is the most dangerous moment and must follow strict safety rules:

A firing zone must be designated, with access forbidden to the public before, during, and after the firing, until the firing area is cleaned;

Barriers and warning signs must limit public access to the firing zone;

The firing zone should be monitored from the installation of the pyrotechnics until the area is cleaned after the show;

Firefighting equipment should be on-site, and a “rescue point” marked with a sign;

After the show, the zone must be cleaned, and all debris collected.

<p,Faulty or unused pyrotechnics can be stored for a maximum of 15 days after firing. Afterward, they must be returned to the manufacturer or reseller.

What guarantees must a pyrotechnician have?

“Cancellation” guarantee

Insurance for pyrotechnicians includes the ” Cancellation ” guarantee. It covers non-refundable expenses or the sale price of a service once the fireworks or pyrotechnic show is:

  • Cancelled,
  • Interrupted
  • or rescheduled,
  • Partially or fully, for reasons beyond the organizer’s control.

“Financial Loss” Cancellation Guarantee

– Basic guarantees covering Force Majeure cases

  • Site unavailability
  • Inaccessibility to the site
  • Strikes
  • Public protests
  • Withdrawal of authorization
  • Attacks and threats/Terrorist acts

– Extension of coverage for weather conditions and climatic factors

  • Storm
  • Heavy rain
  • Wind
  • <li Hail
  • Snow

And all weather conditions affecting the safety of participants and/or the public, regardless of their severity or strength.

“All risks” Material Damage Guarantee

– Extension of coverage for the unavailability of essential persons

  • Organizer, pyrotechnician, etc., whose absence would lead to event cancellation or rescheduling.
  • Accident
  • Illness
  • Death
  • Family event…

To cover all equipment, accessories, decorations, and setups (rented, loaned, provided, or owned) necessary for the organization of the festival.

  • Theft
  • Vandalism
  • Breach
  • Electrical damages
  • Fire/Explosion
  • NATURAL DISASTER
  • WITH OR WITHOUT transport phases
