Barème of the IRSA – IDA Agreement : Understanding Responsibilities in Case of an Accident

Partager

The IRSA Convention (Compensation and Recourse for Automobile Accidents) proposes a detailed responsibility scale designed to regulate recourse procedures between insurers in the event of road accidents involving multiple vehicles. This system allows for a faster and more fair management of claims, by predefining responsibilities based on the accident circumstances.

1. General Principle of the IRSA Scale

The IRSA Convention scale is designed to simplify and accelerate the processing of recourse cases between insurers. By assigning a fixed responsibility according to the accident details, it helps avoid prolonged conflicts and eases victim compensation.

2. Use of the Responsibility Allocation Scale

According to this scale, responsibility can be shared in different ways, ranging from full responsibility of a single driver to a fair distribution between both parties, based on the incident details.

Responsibility Distribution Table in Case of Accident

Code Description Responsibility Y Responsibility X Remarks
10 X and Y travel in the same direction without changing lanes 0% 100% Rear collision
13 X and Y change lanes 50% 50% Simultaneous lane change
15 Y changes lane 100% 0% Y initiates the lane change
17 Y changes lane and turns left 100% 0% Left turn involved
20 Y crosses the median axis 100% 0% Y crosses the central axis
21 Position on the median axis is indeterminate for X and Y 50% 50% Uncertainty about vehicle positions
30 X has priority from the right in their lane 0% 100% X has priority
31 X has priority and crosses the median axis 0% 100% X has priority, even when crossing the axis
40 X is parked legally 0% 100% Legal parking
43 X is parked illegally 100% 0% Illegal parking
50 Y runs a red light 100% 0% Red light ignored
51 Y ignores police barrier 100% 0% Police instructions ignored
56 Y does not respect traffic bans 100% 0% Clear violation of traffic rules

3. Impact on Compensation

Applying this scale facilitates the compensation of involved parties by specifying each one’s responsibility shares, thus reducing processing times for claims. It also helps maintain harmonious relationships between insurance companies.

4. Conclusion

The adoption of the IRSA Scale by insurers is a key element for effective and transparent management of road accidents. By clearly defining responsibilities, it contributes to a quick and fair resolution of claims, benefiting both insurers and policyholders.
